Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Oktohut Solutions Private Limited, a company incorporated in India with its registered office at AN Square, WG 1-F-3/1120, Unichira Thoppil Road, Marottichuvadu, Edappally, Kochi, Ernakulam, Kerala 682021, India (“A11yRemedy”, “we”, “us”, “our”).

These Terms govern your use of the website at a11yremedy.com, the application at app.a11yremedy.com, the free public accessibility scanner, our API and related services (together, the “Service”). A11yRemedy is a product operated by Oktohut Solutions Private Limited.

If you use the Service on behalf of a company or other organisation, you confirm that you have authority to bind it to these Terms, and “you” means that organisation. If you do not agree to these Terms, do not use the Service.

Effective: 29 September 2026   Last updated: 23 October 2026

1. Definitions

Customer Content: anything you or your Authorised Users submit to the Service, including website addresses, settings, login credentials for scanning, logos, branding, statement and document content, and messages.

Scan Results: the findings, reports, suggested fixes, accessibility statements, VPAT drafts and other output the Service generates for you.

Authorised Users: people you invite to your organisation account.

End Client: a client of yours to whom you provide services using the Service, including under your own brand.

2. Eligibility and accounts

2.1 You must be at least 18 years old to use the Service.
2.2 The Service is designed for business and professional use. Individuals such as freelancers and sole traders may use it, but by accepting these Terms you confirm you are using the Service for business or professional purposes and not as a consumer. Nothing in these Terms removes rights you have under consumer protection laws that cannot be excluded by contract.
2.3 You must give accurate registration information and keep it up to date.

2.4 You are responsible for keeping your login details secure, for all activity under your account, and for making sure your Authorised Users follow these Terms. Tell us promptly at support@a11yremedy.com if you suspect unauthorised access to your account.

3. What the Service does, and what it does not do

3.1 A11yRemedy scans websites with automated accessibility tests, tracks changes between scans, and produces reports with suggested code-level fixes, together with draft accessibility statements and draft VPAT documents.

3.2 Automated testing has limits. Automated tools, including ours, can detect only some of the accessibility barriers on a website. Many WCAG success criteria require human judgement and testing with assistive technology. A scan with no reported issues does not mean a website is accessible.

3.3 No compliance guarantee. The Service does not certify, guarantee or represent that any website conforms to WCAG or complies with the Americans with Disabilities Act, Section 508, the European Accessibility Act, EN 301 549, the Accessibility for Ontarians with Disabilities Act, the Rights of Persons with Disabilities Act, 2016 (India), or any other law or standard. Using the Service does not protect you or anyone else from complaints, demand letters, lawsuits or regulatory action.

3.4 Not legal advice. A11yRemedy is a software tool, not a law firm. Nothing in the Service, including reports, accessibility statements and VPAT drafts, is legal advice. Statements and VPATs generated by the Service are drafts. You are responsible for reviewing them, completing them accurately, and for any statement you or your End Clients publish. For advice on your legal obligations, consult a qualified lawyer.
3.5 Suggested fixes need review. Suggested fixes are generated automatically and may be incomplete, or not suitable for your code base. A qualified developer should review and test every change before it goes live. You are responsible for changes made to your websites and your End Clients’ websites.
3.6 Not an overlay. The Service does not inject scripts into, or change, your live website. It only reads pages in order to test them.
3.7 Standards change. Accessibility standards, laws and their interpretation change over time. We work to keep our rules current but do not guarantee that the Service reflects the latest version of any standard at any given time.

4. Authorisation to scan

4.1 You may only scan websites that you own or that you have the owner’s permission to test. This applies to the free public scanner as well as the application.
4.2 If you give us login credentials or cookies for authenticated scanning, you confirm you are authorised to use them for this purpose. Use a dedicated, least-privilege test account wherever possible. The scanner loads pages the way a visitor’s browser would, so do not configure it to scan pages where loading a page could place an order, send a message, delete data or trigger any other action.
4.3 You are responsible for any load, cost or consequence that scans you configure cause to the websites being scanned, including security alerts on those websites. We may limit crawl speed and scan scope.
4.4 Our scanner identifies itself with a user agent. We may stop scanning any website if its owner objects, or if we reasonably believe you are not authorised to scan it.

5. Acceptable use

You must not, and must not allow anyone else to:

scan, probe or attack systems you are not authorised to test, or use the Service to reach internal, private or restricted networks;
use the Service for security testing, vulnerability scanning or penetration testing;
try to get around rate limits, plan limits, access controls or security measures, or probe the Service for vulnerabilities without our written permission (report vulnerabilities to support@a11yremedy.com);
overload or disrupt the Service or any website;
upload malware, or content that is unlawful, infringing or harmful;
share API keys or account credentials with unauthorised people;
resell, sublicense or provide access to the Service itself to third parties, except as allowed for agencies in section 8;
copy, reverse engineer or build a competing product from the Service, except to the extent the law allows despite this restriction;
use Scan Results to harass or harm the owners of scanned websites;
present Scan Results as a certification, guarantee or legal opinion of accessibility compliance;
use the Service in breach of any applicable law, including data protection, computer misuse and export control laws.

6. Plans, trials and payment

6.1 Our reseller, Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a subscription, you buy it from Paddle, and your purchase is also governed by the Paddle Buyer Terms (paddle.com/legal/buyer-terms), which you will be asked to accept at checkout. We license the Service to you and continue to support it. Paddle issues invoices and receipts, collects payment, and calculates and collects applicable sales tax, VAT or GST.
6.2 Plans. Features and limits, such as the number of sites, the page allowance and scan frequency, depend on your plan as described on our pricing page (a11yremedy.com/pricing) at the time you subscribe.
6.3 Free plan. We offer a free plan with reduced limits. We may change the limits of the free plan, or withdraw it, at any time.

6.4 Free trials. We may offer a free trial of a paid plan. You do not need to enter payment details to start a trial unless the offer says otherwise. When the trial ends, your account moves to the free plan unless you choose a paid plan. Data and settings above the free plan’s limits may become unavailable until you upgrade.

6.5 Prices and currency. Prices are in US dollars. Applicable taxes are calculated by Paddle and shown at checkout before you pay.

6.6 Billing and renewal. Paid plans are billed in advance, monthly or annually. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. By subscribing, you authorise Paddle to charge your payment method for each renewal.

6.7 Price changes. We may change our prices. Changes apply to existing subscriptions from your next renewal after we have given you at least 30 days’ notice by email. If you do not agree, you can cancel before the change takes effect.

6.8 Upgrades and downgrades. Plan changes take effect immediately. For an upgrade, Paddle charges a prorated amount for the rest of the current billing period. For a downgrade, Paddle adds a prorated credit for the unused part of your current plan to your account, and that credit is used automatically against your future payments. If you downgrade, data or features above your new plan’s limits may become unavailable.

6.9 Cancellation. You can cancel at any time from your account’s billing settings. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then. We do not refund partial billing periods except as set out in our Refund Policy.

6.10 Refunds. Refunds are covered by our Refund Policy (a11yremedy.com/refund-policy), which forms part of these Terms, and by the Paddle Buyer Terms.

6.11 Failed payments. If a renewal payment fails, Paddle will retry it. If payment is still not received 14 days after the first failed attempt, we may move your account to the free plan until payment is made.

7. Customer Content and Scan Results

7.1 Your content stays yours. You keep all rights in your Customer Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process and display Customer Content only as needed to provide, secure and support the Service, and as described in our Privacy Policy.

7.2 Your responsibility. You are responsible for your Customer Content and confirm that you have the rights needed to submit it, including rights in any logo or brand you upload.

7.3 Scan Results. As long as you comply with these Terms and pay applicable fees, you may use, copy, change and share Scan Results for your own business, including giving them to your End Clients. You may use suggested code fixes in your own websites and your End Clients’ websites.

7.4 Published statements. If you publish an accessibility statement through the Service, it is publicly visible on our domain until you unpublish it. You are responsible for its content.

7.5 Aggregated data. We may use aggregated, de-identified data about use of the Service and about patterns in accessibility issues to operate and improve the Service and to publish general statistics. Such data will not identify you, your End Clients or any individual.

7.6 No model training. We do not use your Customer Content or Scan Results to train machine-learning models.

7.7 Customer references. We will not use your name or logo in our marketing without your permission.

8. Agencies, white-label use and End Clients

8.1 On plans that include white-label features, you may present reports and documents under your own brand and give them to your End Clients as part of your services.

8.2 You are solely responsible for your End Clients, including your contracts with them, your pricing, your support, and anything you promise them. You must not make representations to End Clients on our behalf, or describe Scan Results as a certification or guarantee of compliance.

8.3 You must have your End Clients’ authorisation to scan their websites (see section 4) and a lawful basis for sharing any of their personal data with us.

8.4 We have no obligations to End Clients, and End Clients are not third-party beneficiaries of these Terms.

9. Our intellectual property

9.1 We and our licensors own the Service, including its software, design, rules and templates. Apart from the rights expressly given to you in these Terms, no rights are transferred to you.

9.2 The Service uses axe-core by Deque Systems, Inc., licensed under the Mozilla Public License 2.0, and other open-source components under their own licences. Nothing in these Terms limits your rights under those licences.

9.3 If you give us feedback or suggestions, we may use them without any restriction or obligation to you.

9.4 You may not use our name, logo or trademarks without our prior written permission, except to truthfully state that you use the Service.

10. Confidentiality

Each party will keep the other party’s non-public information confidential, use it only to perform under these Terms, and protect it with at least reasonable care. This does not apply to information that is or becomes public through no fault of the recipient, was already known to the recipient, was independently developed, or was lawfully received from a third party. A party may disclose confidential information where the law requires it, after giving the other party notice where legally allowed.

11. Data protection

11.1 Our Privacy Policy (a11yremedy.com/privacy-policy) explains how we handle personal data.

11.2 Where we process personal data on your behalf, our Data Processing Addendum (a11yremedy.com/data-processing-addendum) applies and forms part of these Terms.

12. Availability and changes to the Service

12.1 We aim to keep the Service available but do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, and will try to schedule it to minimise disruption.

12.2 We may change, add or remove features. If we remove a material feature of a paid plan during your billing period, we will give you reasonable notice, and if you cancel as a result, we will refund the prepaid fees for the unused part of that period.

12.3 Features marked beta, preview or experimental are provided as they are, may change or be withdrawn at any time, and are excluded from any commitments in these Terms.

12.4 The Service depends on third-party providers such as hosting, email and payment providers. We are not responsible for their failures where these are beyond our reasonable control.

13. Suspension and termination

13.1 You may stop using the Service and close your account at any time. Closing your account cancels any subscription at the end of the current billing period.

13.2 We may suspend or terminate your access immediately if you materially breach these Terms (including sections 4 and 5), if your use creates a security or legal risk for us or others, or if the law requires it. Where it is reasonable to do so, we will give notice and a chance to fix the problem first. If we terminate for your breach, no refund is due.

13.3 We may terminate these Terms for convenience by giving you 30 days’ notice. In that case we will refund prepaid fees for the unused part of your billing period.

13.4 Your data after closure. For 30 days after your account is closed, you may ask us to export your Scan Results in a standard format. After that, we will delete your Customer Content and Scan Results, except where the law requires us to keep records. Deleted data can remain in backups until they expire, as described in our Privacy Policy.

13.5 Sections that by their nature should survive termination will survive, including sections 3, 7.5, 9, 10 and 14 to 19.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Service and Scan Results are provided “as is” and “as available”. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. In particular, we do not warrant that the Service will detect all accessibility issues, that suggested fixes will resolve them, or that any website will be accessible or legally compliant.

15. Limitation of liability

15.1 To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business, goodwill or data, even if advised of the possibility of such damages.

15.2 To the maximum extent permitted by law, we are not liable for complaints, demand letters, lawsuits, settlements, fines or other legal outcomes arising from reliance on Scan Results, suggested fixes, accessibility statements, VPAT drafts or any other output of the Service.

15.3 To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the fees you paid for the Service in the 12 months before the event giving rise to the claim, and (b) USD 100.

15.4 Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

16. Indemnity

You will defend and indemnify us, our affiliates and our personnel against third-party claims, and the related losses, damages and reasonable costs (including legal fees), arising from: (a) scans you configure of websites you were not authorised to test; (b) your Customer Content; (c) your breach of these Terms or of applicable law; or (d) your services to your End Clients and anything you or they publish or claim about accessibility, including accessibility statements.

17. Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or in the app at least 30 days before it takes effect, unless the change is required by law or relates only to a new feature. If you keep using the Service after a change takes effect, the updated Terms apply. If you do not agree, you may cancel before the change takes effect.

18. Governing law and disputes

18.1 These Terms are governed by the laws of India.

18.2 The parties will first try to resolve any dispute through good-faith discussion. Any dispute not resolved within 30 days of written notice will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement of the parties. The seat and venue of arbitration will be Kochi, Kerala, India, and the proceedings will be conducted in English.

18.3 Subject to section 18.2, the courts at Kochi (Ernakulam), Kerala, have exclusive jurisdiction. Either party may seek urgent interim relief from a competent court.

18.4 If mandatory laws of your country give you rights that these Terms cannot override, those rights still apply.

19. General

Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, Data Processing Addendum and any order form signed by both parties, are the entire agreement between us about the Service. If there is a conflict, a signed order form takes priority over these Terms.

Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate, or in connection with a merger, acquisition or sale of assets.

Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, other than payment obligations.

Severability. If any provision is found unenforceable, the rest of these Terms remains in effect.

No waiver. Failure to enforce a provision is not a waiver of it.

Independent parties. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.

Notices. We may send notices to the email address on your account. You may send notices to support@a11yremedy.com.

Language. These Terms are written in English. Any translation is for convenience only.
